Legal Entity of Collection Agency

As interpreted legally a Collection Agency pertains to any person or an organization of persons, who take the responsibility for collection of debts of some other money lending individual or for a financial institution like Banks, Trusts etc. and getting contracted fee for the services rendered.

They are working on behalf of another organization under instructions and authorization in this respect.

Governing Regulations of Collecting Agency:

A collecting agency working on behalf of the creditor takes the total responsibility of its accounts, billing, collection instituting legal proceeding, where required in its own capacity as a concerned party.

The legal proceeding if need to be initiated with proper assignment of the debt in their favor and holding proofs of debt liability and is further required to observe the following:

The assignment of debt was a voluntary act and has the approval of the creditor, who is availing the services of the collecting agency. It was not required by the agency to list the account, bill or other proofs of liability, with the agency, as a pre condition.

The assignment job is on an attested legal document having information regarding date of execution, the charges paid by the creditor for the service, with a clear authorization to deal with the debt and referring to the proof of the debt liability to be given to an attorney engaged for legal proceedings. The document shall form evidence in the legal proceedings, with further authority to merge the accounts along with other accounts to file a joint suit involving multiple debtors.

After assigning the account to the collecting agency the account held by the creditor is not maintained and duly cancelled on the date of assignment
It is mandatory that the collecting agency shall initiate proceedings in a court where the debtor is residing or in a country where one of the co-debtors is residing.
Collection Agency shall initiate legal proceedings represented by a lawyer having permission to practice in a particular state.
