IRS CP59 And CP63 Notices: Check Missing Returns And Refund Holds

The Short Answer
CP59 says the IRS has no record of a prior-year personal tax return. CP63 says a refund is being held because the IRS believes one or more returns are missing and additional tax may be owed. Match the notice to the exact year, then check whether the return was filed, rejected or never submitted. Follow the response route for your notice; filing evidence and a confirmed refund release are separate records.

What Is The Difference Between CP59 And CP63?

NoticeOfficial ExplanationFirst Record Check
CP59The IRS has no record of a prior-year personal return.Identify the tax year and match your filing evidence.
CP63The IRS is holding a refund because returns appear missing and it expects additional tax.Identify every year named and keep the refund-hold status separate.

Compare the actual letter with the current CP59 guidance and CP63 guidance. A return from this year does not prove the particular older return named in the notice was filed.

What Evidence Should I Gather If I Already Filed?

Make one private row for each tax year: form, taxpayer name, preparation date, submission date, acceptance or delivery evidence, any rejection and the unresolved question. Keeping these stages separate helps you describe what actually happened.

A saved tax-software file is preparation evidence, not proof the IRS received the return. A mailing receipt and a processed return are also different records. Record what each item establishes without inventing a missing confirmation.

What Do The IRS Instructions Say About Recently Filed Returns?

Both official notice pages say no further action is needed if the relevant return was filed within the last eight weeks. That guidance refers to the return the notice is about, not an unrelated current-year filing. Check your filing date and any rejection first; clarify conflicting or additional instructions with the IRS.

For CP59 when more than eight weeks have passed or the return was not filed, the official page describes checking identifying information and sending a signed and dated return copy. For CP63, its disagreement or older-filing guidance describes calling the notice number with paperwork, or writing to the notice address. Do not assume a response method listed for one notice applies to the other.

This is notice-specific guidance, not a promised processing period or an extension of a separate deadline. Keep any additional letter and its response requirements in your log.

When Is Form 15103 Relevant?

The CP59 page identifies Form 15103, Form 1040 Return Delinquency, for explaining a mistake or filing situation. The current PDF has a June 2017 revision; an old revision date alone does not prove the official linked form is obsolete.

The form distinguishes an already-filed return from an explanation that a return was not required. It asks for year-specific information and contains a signature certification. Read both sides and use the instructions supplied with your notice. An explanation should describe the actual facts, not a guessed reason or a blanket statement covering every year.

The CP59 page lists mail, fax and applicable signed online-form routes. Protect sensitive documents and use the official route applicable to your case. A CuraDebt consultation or upload to a third-party website does not send the form to the IRS.

What If I Have Not Filed Or Believe Filing Was Not Required?

The IRS past-due-return guidance says to file required returns even when full payment is unaffordable and to use the location on a received notice. Filing obligations and payment options are separate questions. Do not decide a return was unnecessary only because you expect no refund or cannot pay.

When records are missing, identify the documents needed for that year, such as income and withholding records, instead of copying another year's figures. The IRS describes wage-and-income and prior-return transcript routes on its official page. A transcript can help reconstruct records; it does not itself file a return.

If you believe no return was required, check the year-specific rules or get advice from an appropriately authorized tax professional. The CP59 guidance also identifies a special route for bona fide residents of certain U.S. territories who filed with their territory tax office: obtain that office's guidance for the particular situation.

Does Sending A Return Automatically Release A CP63 Refund Hold?

No guaranteed release date follows from sending documents. The CP63 instructions describe a hold until the IRS receives the missing returns or an acceptable explanation, and say that a determined tax balance may use some or all of the refund. Keep submission, account review and actual refund status as separate entries.

If you also receive CP21B after a requested return adjustment, match the adjustment notice to later payment evidence. Keep that record separate from the CP63 hold and your proof of filing.

A Useful Follow-Up Log. Record the date, notice and year; what you submitted; official destination; submission evidence; requested follow-up; and the next actual IRS update. Leave the result blank until verified. This checklist organizes records and does not determine your filing requirement or refund eligibility.

An LT16 checklist for separate missing-return and balance issues covers another notice. A guide to matching reported income records addresses a different document. Follow each actual notice rather than assuming one packet answers every IRS request.

What If The Filed Return Shows Tax I Cannot Pay?

Use the IRS payment-plan guidance after identifying the actual balance. You can contact the agency directly or an appropriately authorized professional. An available payment option does not establish that an unfiled return has been received or a refund hold removed.

CuraDebt's free evaluation reviews available tax-debt options, not return preparation, an IRS response or a guaranteed refund. The FTC cautions against promised tax-relief outcomes. Do not let a consultation replace the response your notice requires.

Frequently Asked Questions

Does CP59 Prove That I Never Filed?

It reports that IRS records show a missing prior-year return. Match the exact year and taxpayer information with your filing, acceptance or delivery evidence and check for rejection.

Does CP63 Mean My Refund Has Already Paid A Tax Debt?

CP63 describes a refund hold associated with missing returns. A hold is different from a refund already applied to tax debt; use the actual notice and account records.

Is Form 15103 A Payment-Plan Application?

No. It concerns Form 1040 return delinquency and explanations of filing circumstances. Use the actual notice instructions; payment arrangements are a separate task.

Will A Submitted Return Guarantee A Refund Release Date?

No. Submission, IRS review and confirmed refund status are separate records. A tax balance or other applicable issues can affect the result.
