Terms of Service
These Terms of Service (“Terms,” “Agreement”) govern your access to and use of the websites, mobile applications, content, tools, and services (collectively, the “Service”) operated by CuraDebt Systems, LLC (“CuraDebt,” “we,” “us,” or “our”). Where a form or account screen asks you to accept these Terms, you agree by taking the acceptance action identified on that screen. Our Privacy Policy explains our data practices. Accepting these Terms does not, by itself, authorize form recording, optional cookies, or advertising measurement; the applicable notices and choices govern those permissions.
Section 14 contains a binding arbitration provision and a class-action waiver that affect your legal rights and require most disputes to be resolved on an individual basis. You may opt out of arbitration within 30 days as described in that section.
If you do not agree to these Terms, do not use the Service.
1. Who We Are and What We Do
CuraDebt currently uses this Service primarily as a referral and matching platform for consumers seeking debt relief, tax resolution, and certain business or merchant cash advance (MCA) debt assistance. When you use the Service, we generally collect information, apply basic matching criteria, and facilitate a referral to an independent third-party provider or law firm (each, a “Network Partner” or “Provider”).
CuraDebt may also continue to service certain legacy client relationships established prior to our transition to a matching model. Where you are an existing legacy client, the separate written agreement governing that relationship continues to control, and in the event of any conflict between that agreement and these Terms, that agreement governs for that relationship.
Except for legacy relationships described above, our role for new consumers is limited to collecting information, applying matching criteria, and facilitating a referral. We do not perform the matched Provider’s services and do not control a Provider’s services after a referral is made. Services are not available in all states.
2. Eligibility and Geographic Scope
The Service is intended only for individuals who are at least 18 years of age and who are accessing the Service from a physical location within the United States. By using the Service, you represent and warrant that you are at least 18 years old and are accessing the Service from within the United States. The Service is not directed to children, and we do not knowingly collect information from anyone under 18.
3. Definitions
- “You” or “your” means the person using the Service, and any person on whose behalf you are authorized to act in using the Service.
- “Network Partner” or “Provider” means an independent third-party debt relief company, tax resolution firm, law firm, lender, servicer, or other entity to which you may be matched or referred through the Service.
- “Form” means any request, inquiry, or submission you make through the Service to be matched with CuraDebt’s services and/or a Provider.
- “Content” means all text, graphics, images, logos, video, audio, software, code, and the selection, arrangement, and “look and feel” of the Service.
4. The Matching Service and Your Acknowledgments
When you submit a Form, you are not submitting an application for credit, debt relief, tax, or legal services. You are submitting an inquiry to be matched with CuraDebt and/or the Provider or Providers named in the Form’s consent disclosure (on most Forms, one matched Provider) who may be able to assist you. Information for another service category is shared with a Provider for that category only if you separately select it. CuraDebt may also follow up with you by email, text message, or phone about your match, your experience, and to request feedback, as described in that disclosure, subject to debt type, state availability, Provider participation, and applicable law.
You acknowledge and agree that:
- CuraDebt is not a lender, creditor, debt collector, law firm, or tax preparer, and except where expressly provided by applicable state law, CuraDebt is not acting as your agent or as the agent of any Provider.
- A matched Provider operates independently from CuraDebt. The Provider’s own terms, engagement letter or client agreement, and privacy policy govern your relationship with that Provider.
- CuraDebt does not direct or control a Provider’s professional judgment and does not guarantee or warrant any Provider’s services, results, conduct, fees, or data practices.
- Acceptance into any particular program, and the specific terms offered, are determined solely by the individual Provider. You may not be matched with any specific Provider, and matching does not guarantee approval, enrollment, or any particular outcome.
- Your decision whether to engage any matched Provider is solely your own, and you will rely on your own judgment and independent research in deciding which Provider, product, or service suits your needs.
- A Provider may retain the information in your Form and any information provided in processing it, whether or not you enroll, and may be required by law to share certain information with CuraDebt.
A matched provider is independent and is responsible for its own services and professional obligations. CuraDebt does not guarantee a provider’s results and is not responsible for the provider’s acts or omissions except to the extent applicable law imposes responsibility on CuraDebt. This does not exclude liability for CuraDebt’s own conduct or limit non-waivable rights.
5. Consent to Be Contacted (Calls, Texts, and Email)
If you affirmatively agree to a contact disclosure on a form, the consent you give covers only the companies, contact methods and purposes identified in that disclosure. These Terms do not expand it. Permission for automated or prerecorded marketing calls and texts must be obtained where required by law, including when a number is on an applicable Do-Not-Call list. Any prior company-specific opt-out must be handled as required by law.
Consent to automated or prerecorded marketing calls and texts is not a condition of purchasing services. Message frequency varies; message and data rates may apply.
You may revoke permission for calls or texts by any reasonable method that clearly communicates your request, including replying STOP to a text, requesting removal during a call, or contacting [email protected] or 1-877-850-3328. You may unsubscribe from email using its unsubscribe link. We process requests directed to CuraDebt as required by applicable law. A provider may also offer its own contact and opt-out methods; contact that provider to stop its communications. This does not limit any duty CuraDebt has under applicable law.
6. Credit Information and FCRA Authorization
Credit Information. CuraDebt does not obtain a consumer credit report for a bankruptcy evaluation request. Submitting a referral inquiry, accepting these Terms, or consenting to contact does not authorize a credit inquiry. Any consumer-report access requires a permissible purpose and any authorization required by applicable law, presented at the relevant step. A provider’s separate credit-report request is governed by its own disclosures and applicable law.
7. How We Are Compensated
CuraDebt provides referral and matching services to consumers at no separate charge. CuraDebt may earn revenue through referral, marketing, lead-generation, or other lawful compensation arrangements with some Network Partners, while other referrals may generate no compensation at all. Any compensation arrangement is between CuraDebt and the Provider, not the consumer. Compensation arrangements are subject to applicable law. Accepting these Terms does not authorize a payment arrangement prohibited by law.
8. Acceptable Use
You agree to use the Service only for lawful purposes and to provide information that is true, accurate, current, and complete. You are responsible for information you knowingly submit and for activity you authorize through the Service. You agree not to:
- Violate any applicable local, state, federal, or international law or regulation, including the FCRA, the Fair Debt Collection Practices Act, the TCPA, or consumer-protection laws;
- Provide false, inaccurate, or misleading information, or impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Interfere with, disrupt, or place undue load on the Service, its servers, or connected networks, or attempt to gain unauthorized access to any portion of the Service;
- Transmit any viruses, malware, or other harmful code, or engage in scraping, harvesting, or automated data collection without our written permission;
- Reproduce, duplicate, copy, sell, resell, frame, mirror, or otherwise exploit any portion of the Service or Content for any commercial purpose without our prior written consent;
- Use the Service to transmit spam, chain letters, pyramid schemes, or unsolicited commercial messages; or
- Engage in any activity that would aid terrorism or endanger U.S. military personnel, or that is otherwise unlawful or objectionable.
We do not undertake general monitoring of user content. Subject to applicable law, we may review, remove or refuse content, or restrict, suspend or terminate access for security, unlawful misuse, suspected violations of these Terms or other legitimate business reasons. We will provide any notice or access required by law. This provision does not limit the lawful exercise of privacy, accessibility or other non-waivable rights.
9. Account Information and Security
If the Service provides you with account credentials, you are responsible for taking reasonable steps to safeguard them and for activity you authorize through your account. You agree not to share your credentials or allow anyone else to access the Service as you, to log out at the end of each session, and to notify us immediately of any unauthorized use or security breach. To the extent permitted by law, you may be responsible for losses caused by your failure to take reasonable steps to safeguard your credentials or by your unlawful use of the account. This does not excuse CuraDebt from its own applicable security duties or limit any right or remedy that cannot lawfully be excluded.
10. Intellectual Property
All Content on the Service is owned by or licensed to CuraDebt and is protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted, no part of the Service or Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, framed, or mirrored without CuraDebt’s prior written permission. Nothing in this Agreement grants you any license or right to use any CuraDebt name, logo, trademark, or other Content.
11. User-Submitted Content
If you intentionally submit a review, comment or other content for public display, you represent that you have the necessary rights and grant CuraDebt a non-exclusive, royalty-free license to display, reproduce and format that content for the purpose for which you submitted it. We may moderate or decline to publish it. This license does not apply to referral forms, private messages, financial details, privacy requests or consent evidence. Those are handled under our Privacy Policy. Any use of your identity in advertising requires any permission required by law.
12. Third-Party Websites and Links
The Service may contain links to websites operated by third parties, including Network Partners and service providers. These links are provided for convenience only. We do not operate or control those websites, do not endorse them, and are not responsible for their content, products, services, or privacy and data practices. Your use of any third-party website is subject to that party’s own terms and policies and is at your own risk.
13. Disclaimers and Limitation of Liability
THE SERVICE, CONTENT, AND ANY MATCHING OR REFERRAL ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURADEBT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CURADEBT DOES NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL PRODUCE ANY PARTICULAR RESULT. THE INCLUSION OR REFERRAL OF ANY PROVIDER DOES NOT CONSTITUTE AN ENDORSEMENT OR WARRANTY OF THAT PROVIDER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURADEBT AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO THE SERVICE OR ANY REFERRAL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CURADEBT’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THIS AGREEMENT WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND TO THE FULLEST EXTENT PERMITTED BY LAW.
Nothing in these Terms excludes or limits liability, statutory damages, remedies, or rights that cannot lawfully be excluded or limited, including under applicable privacy, communications, consumer-protection and accessibility laws. The $100 limit and other exclusions apply only where enforceable.
14. Dispute Resolution, Binding Arbitration, and Class-Action Waiver
It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
Agreement to Arbitrate. You and CuraDebt agree that any dispute, claim, or controversy arising out of or relating to the Service, this Agreement, our Privacy Policy, or any communications between you and CuraDebt (including the validity, scope, or enforceability of this arbitration provision) (a “Dispute”) shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, rather than in court, except as provided below.
Class-Action and Jury Waiver. To the fullest extent permitted by law, you and CuraDebt may bring claims against each other only in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated or representative proceeding. The arbitrator may not consolidate different persons’ claims or conduct a class or representative arbitration without the affected parties’ written agreement. For disputes validly subject to arbitration, you and CuraDebt waive a jury trial. Nothing in this provision waives public injunctive relief or another right or remedy that applicable law does not permit the parties to waive. If a court determines that particular relief must be heard in court, only that relief will be severed to the extent permitted by law, and the remaining arbitrable claims will remain subject to individual arbitration.
Informal Resolution. Before starting arbitration, either party will send the other a written notice describing the dispute and requested relief and providing a name and a reasonable way to reply. Send notices to [email protected] or the mailing address in Section 20. We will try in good faith to resolve the dispute for 60 days after receipt, unless applicable law or AAA rules require a different process. Any settlement conference is by mutual agreement, with reasonable accessibility accommodations. Applicable filing deadlines are tolled during this period to the extent permitted by law. This process does not delay a privacy request, contact opt-out, arbitration opt-out, qualifying small-claims action, government complaint or application for urgent relief.
Procedure and Location. The Federal Arbitration Act governs the arbitration agreement. The applicable AAA consumer rules govern procedure and hearing format. An in-person hearing will take place in Broward County, Florida, unless the parties agree otherwise or applicable law or AAA rules require a different location for the consumer’s convenience. Telephone, video and written-submission procedures may be used as permitted by the governing rules. The arbitrator may award relief authorized by applicable law, subject only to enforceable limitations in these Terms.
Confidential Information. To the extent permitted by law, the parties will protect non-public documents, personal information and trade secrets obtained solely through arbitration from use or disclosure outside the dispute. This does not prevent disclosures reasonably needed to advisers or witnesses, to pursue or enforce legal rights, to a court or government authority, or as otherwise required or protected by law. Either party may request an appropriate protective order from the arbitrator and may seek additional confidentiality protections by agreement in the particular dispute.
Mass Filings. Any coordinated or mass filing will be administered under the AAA rules and fee schedule that apply. Each claim remains individual unless all affected parties agree otherwise. These Terms do not require claims to be withheld, suspend fees contrary to AAA rules, or make a decision in another person’s case binding on you without your agreement.
Fees and Costs. Payment of AAA filing, administrative and arbitrator fees will be governed by the applicable AAA consumer rules and fee schedule. Each party pays its own attorneys’ fees and costs unless applicable law and the governing rules permit an award. If CuraDebt reasonably believes a claim is patently frivolous or was filed for harassment or another improper purpose, it may provide written notice explaining its grounds and an opportunity to withdraw or correct the claim within 30 days. CuraDebt may seek reasonable attorneys’ fees, costs and sanctions when the arbitrator determines that the applicable legal and rules-based requirements are met, after an opportunity for both parties to be heard. Any award must be authorized by applicable law and the governing rules. Nothing limits a party’s non-waivable statutory right to recover fees or costs.
Your Right to Opt Out of Arbitration. You may opt out of this arbitration provision (including the class-action and jury waiver) by sending written notice within thirty (30) days after you first accept these Terms. Your notice must include your name, a way to contact you, any email address or phone number you used with us, if applicable, and a clear statement that you wish to opt out of arbitration. Send it to CuraDebt Systems, LLC at the address in Contact Us or by email to [email protected] with the subject line “Arbitration Opt-Out.” If you opt out within this window, neither you nor CuraDebt will be bound by the arbitration provision as to claims between you and CuraDebt. Opting out has no effect on any other part of this Agreement and will not affect any other agreement you may have with CuraDebt or with a matched Provider.
Exceptions. Either party may bring its own qualifying individual claim directly in small-claims court. If a claim is filed with AAA, either party may request in writing that it proceed in small-claims court; the request, any disagreement about jurisdiction, and closure of the arbitration will be handled under the applicable AAA rules. Either party may seek court relief to protect intellectual property or confidential information, or urgent interim relief permitted by law, without waiving arbitration of arbitrable merits. Nothing prevents a government complaint, privacy request, contact opt-out, accessibility request or legally protected relief.
Time Limit. Claims must be brought within the period provided by applicable law. These Terms do not shorten that period. Any agreed informal-resolution period will toll the deadline to the extent permitted by law.
Severability of this Section. If the class-action waiver above is found unenforceable as to a particular claim, then that claim (and only that claim) shall be severed and may proceed in court, while all other claims remain in arbitration. If any other portion of this Section is found unenforceable, the remainder shall be enforced to the fullest extent permitted by law.
15. Governing Law and Venue
Florida law governs these Terms, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the arbitration agreement and non-waivable protections of other applicable law remain available. Subject to Section 14, any matter properly proceeding in court, including a proceeding concerning an arbitration award, must be brought exclusively in the state or federal courts located in Broward County, Florida, unless applicable law or the governing AAA rules require a different forum. You and CuraDebt consent to personal jurisdiction and venue in those courts. This provision does not restrict government authority or a forum that applicable law requires to remain available.
16. Changes to These Terms
We may modify these Terms or the Service and will identify the Last Updated and effective dates of a revised version. We will provide notice of material changes and obtain acceptance where required by applicable law. Where permitted by law, continued use after actual notice and the stated effective date may constitute acceptance. Changes apply prospectively and do not alter an existing dispute or a prior consent record without the parties’ agreement. We retain prior versions as reasonably needed for legal and recordkeeping purposes.
17. General Provisions
Entire Agreement. This Agreement, together with the Privacy Policy and any additional terms presented for specific services, constitutes the entire agreement between you and CuraDebt regarding the Service and supersedes all prior or contemporaneous communications, except that any separate written agreement governing a legacy client relationship controls for that relationship.
Severability. If any provision of this Agreement is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions shall remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign this Agreement without our written consent. We may assign it in connection with a merger, acquisition, or sale of assets.
Survival. Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, arbitration, governing law, and these general provisions survive termination of this Agreement.
18. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless CuraDebt and its officers, members, employees, agents, affiliates, successors and assigns from third-party claims, losses, liabilities and reasonable expenses, including attorneys’ fees, to the extent caused by your material breach of these Terms, unlawful misuse of the Service, or infringement of another person’s rights. This obligation does not apply to ordinary lawful use of the Service, a good-faith complaint or exercise of privacy or accessibility rights, claims you bring against CuraDebt, or CuraDebt’s own conduct to the extent responsibility cannot lawfully be transferred. CuraDebt may assume the defense and control of a matter properly subject to this indemnity, and you agree to cooperate reasonably and not settle that matter without CuraDebt’s prior written consent. Any defense or reimbursement obligation remains subject to applicable law.
19. Important Disclosures
Debt settlement services are not appropriate for everyone and are not offered directly by CuraDebt to new consumers under the matching model. Failure to pay debts in a timely manner may result in increased balances, late fees, and additional interest, may harm your credit rating, and may lead creditors or collectors to pursue collection activity, including litigation. Not all creditors will agree to reduce balances. Programs offered by Network Partners vary, results vary, and no specific outcome, amount, percentage, or timeframe is guaranteed. Before enrolling with any Provider, review and understand all of that Provider’s program materials and agreements. It is advisable to consult a tax professional regarding any tax implications of debt resolved for less than the full balance.
CuraDebt does not record phone calls. A company you choose or are matched with may record or monitor calls under its own notice and privacy policy. Online form consent certification is separate and is described in our Privacy Policy. If CuraDebt introduces call recording in the future, we will update our disclosures and provide any required notice and obtain any required consent before recording begins. CuraDebt Systems, LLC maintains a non-discriminatory policy based on race, color, religion, sex, marital status, national origin, or ancestry. In CT, DE, GA, HI, ID, KY, LA, ME, MT, NV, NH, NJ, ND, OH, PR, RI, SC, VT, WI, and WY, CuraDebt does not provide debt settlement or adjustment services and instead may forward the consumer to a law firm that may be able to assist in providing similar services as part of its practice.
