IRS Form 12153: Organize Your Hearing Request And Records

Form 12153 requests a Collection Due Process (CDP) or equivalent hearing after a notice offers those rights. Start with that notice: identify the tax periods, hearing deadline and submission instructions. Then organize the issue and supporting records. Preparing a form, sending it and receiving a decision are separate steps.

Which Notice Belongs With Form 12153?

The current IRS form and instructions cover notices offering CDP rights under sections 6320 or 6330. Include the relevant notice and use its hearing-request address, which may differ from the payment address. Ask the notice contact about unclear routing.

Make a cover sheet for your own records. Copy the notice identifier, notice date, tax type, periods, response date and submission route. If two letters concern different periods, keep their instructions separate. Do not assume one request covers every IRS balance.

If the hearing notice identifies Form 941 periods, build a quarter-by-quarter payroll record index for the issue being discussed. Keep record preparation separate from the hearing-request deadline and eligibility rules.

For a CP90 letter, our notice-specific hearing-rights guide supplies additional context. A defaulted installment agreement may involve a different appeal procedure; review the guide to a proposed agreement termination rather than automatically selecting this form.

What Should I Check Before Sending The Packet?

Use this original organizer beside the official instructions. It helps find missing records; it is not an IRS form, legal filing or determination of eligibility.

Print Or Download The Record Organizer

Use this one-page worksheet to organize your documents and questions offline. Open the PDF to print it or save a copy. No email address is required. Keep completed copies private. This organizer is not an IRS form and does not submit a request or extend a deadline.

The form requires a reason and signatures. Follow its joint-request and representative instructions where applicable. Financial information may be needed for collection alternatives; the instructions discuss Forms 433-A and 433-B and exceptions. Do not hold a time-sensitive request merely to finish a personal organizer; promptly clarify any missing required material with the IRS or an authorized professional.

When plain Form 433-A is actually requested, organize the financial figures and supporting records as a separate task. That preparation does not extend the hearing-request deadline.

How Do I Make My Explanation Useful?

Separate the question from the supporting document. “I disagree” gives the reader little to locate. A better preparation note names the period, the disputed event, the record and the question that record raises. Use only facts you can support.

Illustrative Record Note. “My payment confirmation identifies (tax period) and (payment date). The notice lists that period, but I cannot reconcile the payment with its balance. Attachment A is the confirmation; Attachment B is the account record dated (check date). Please review the posting.” This is a recordkeeping example, not a complete appeal or a conclusion that the IRS made an error.

Replace placeholders privately and label attachments consistently. Keep an unresolved question marked unresolved instead of guessing. The IRS CDP questions and answers explain that disputing the underlying tax liability is allowed only in limited circumstances. An argument about collection is not automatically a new opportunity to contest the assessed tax.

What Changes If The Request Is Late?

IRS Publication 1660 distinguishes timely CDP requests from equivalent hearings. A timely CDP process generally restricts levy for the covered taxes and periods, subject to exceptions, and suspends the collection limitations period. An equivalent hearing does not provide those same effects or the same route to Tax Court review of its decision.

Timing depends on whether the notice concerns a lien or levy. The publication describes separate equivalent-hearing limits and the form includes an equivalent-hearing election. Use the actual notice and current instructions; obtain prompt case-specific help if timing is uncertain. A conversation about payment does not extend the CDP request period.

How Do I Track What Happens Next?

Keep four dated entries: prepared, sent, acknowledged and decided. Attach evidence to each entry. A saved PDF proves preparation; it does not prove delivery. A delivery record does not prove the IRS agreed with the request. Record later document requests and their own response dates separately.

Keep the original packet unchanged in your files. If you later supply a correction, label its date and purpose so you can explain which version was submitted. Store taxpayer identifiers and records privately, not in social comments or an evaluation form.

Where Can I Get Help?

You may contact the IRS directly or seek an appropriately authorized tax professional. The FTC explains tax-help options and cautions against promised results. A Low Income Taxpayer Clinic may help eligible taxpayers with a dispute. If confirmed tax debt remains unaffordable, CuraDebt offers a free options evaluation. That evaluation does not file the request, extend a deadline or provide legal representation.

Does Saving A Completed Form Prove I Submitted It?
