IRS CP90 Notice: Levy Warning, Hearing Rights And Next Steps

The Short Answer
CP90 tells you the IRS intends to levy certain assets for unpaid taxes and informs you of Collection Due Process hearing rights. Read the hearing deadline on your actual notice promptly. Calling the IRS or requesting an evaluation does not extend the deadline for a hearing request.

What Does A CP90 Notice Mean?

CP90 concerns an intended levy and your opportunity for a Collection Due Process (CDP) hearing. A levy involves taking property or rights to property to satisfy tax debt. The notice is not, by itself, proof that funds have already been taken. The IRS CP90 guidance explains the notice and available response routes.

If you are sorting several IRS documents, use the balance reminder checklist for CP501 and the itemized document response log for Form 9297. These documents serve different purposes; follow each document's own instructions and dates.

Check the taxpayer, tax type, tax period, balance and requested action. A general balance reminder and a letter offering hearing rights are different documents. If the number is CP161, use our balance-and-payment checklist instead. Keep later letters because they may contain another action or deadline.

A separate CP508C certification creates another reader task: check the tax certification and passport records independently. Do not treat a CP90 hearing request as confirmation of a passport decision.

Check The Full Notice Number

A final letter in the notice number can change what the document means. The IRS levy-programs toolkit lists CP90 as a pre-levy notice for individuals and CP90C as a post-levy notice for an individual federal contractor. They are different notices.

Read The Number, Then The Instructions
If your document says CP90C, do not apply this CP90 guide's pre-levy assumptions. Follow that document's action and hearing instructions, and seek qualified help if funds have already been taken or the timing is unclear.

Check The Hearing Deadline Before You Call

For a levy notice offering CDP rights, the usual hearing-request period is 30 days from the notice date. Use the date and instructions printed on your CP90, not the day you opened the envelope. IRS Publication 1660 explains the timing rules and exceptions. Seek prompt qualified help if the letter arrived late or its deadline is unclear.

Two Separate Tasks
A conversation about the balance is not the hearing request. IRS collection contact does not extend the CDP request period. Keep the hearing deadline visible while discussing payment or correction options.

The IRS identifies Form 12153 for requesting a CDP or equivalent hearing. Review its current instructions, identify the taxes and periods involved, include the notice and follow the notice-specific submission route. The hearing-request address can differ from the payment address. Keep a complete copy and proof of submission.

The CP90 instructions currently describe the IRS Document Upload Tool when your notice provides an access code, and mailing when that route cannot be used. Follow your actual letter and current IRS instructions. Do not send personal tax documents through a social-media message or this website’s evaluation form.

What If The CDP Request Is Late?

A late CDP request may qualify for an equivalent hearing within the separate time limit. IRS Publication 1660 explains why the two routes are different:

Timely CDP And Equivalent Hearings For A Levy Notice
QuestionTimely CDP HearingEquivalent Hearing
When Is It Requested?Within the notice's CDP request period, usually 30 days from the levy notice date. For a levy notice, within one year of the notice date, under the applicable instructions.
Is Levy Action Restricted?Generally for the tax and periods covered during the timely hearing process. Statutory exceptions apply. The equivalent-hearing request does not legally prohibit levy action.
Can The Decision Be Reviewed In Tax Court?A determination may be challenged by a timely Tax Court petition under its instructions. The equivalent-hearing decision does not provide the same Tax Court review route.

The exceptions include jeopardy, state income tax refund, federal contractor and disqualified employment tax levies. A qualified tax professional should assess the actual notice, timing and remaining options. Calling the IRS does not extend the CDP request period.

Organize A Short Response File

Build one folder so the person helping you can see the account and chronology without relying on memory:

If your employer later provides a separate wage-levy packet, check the payroll statement and exemption inputs for that document. Returning an employee statement is not a CP90 hearing request.

  1. Notice: Keep every page, the envelope, notice date and stated hearing deadline.
  2. Taxpayer and periods: List exactly which account, tax form and periods the notice identifies.
  3. Balance: Compare returns, account records, payments and credits. Flag a mismatch with its supporting document.
  4. Earlier correspondence: Keep prior notices, dispute records and any payment-arrangement confirmation.
  5. Submission record: Keep the request, attachments, receipt and a dated contact log.

A useful contact note records the date, issue discussed, documents requested and next action. Distinguish something requested from something confirmed or approved. Our overview of other tax letters provides additional context.

What If You Cannot Pay The Balance In Full?

The IRS CP90 page points readers toward payment arrangements and other resolution possibilities. Under the current payment-plan rules, eligibility, fees and requirements vary. Interest and applicable penalties can continue during an installment agreement. Confirm approval status and terms rather than assume a request has resolved the account.

IRS collection guidance also describes potential offers in compromise or temporary collection delay when the requirements are met. An offer is not a guaranteed discount, and a delay does not erase the balance. Gather financial records to discuss realistic options with the IRS or an authorized professional while preserving the hearing deadline.

Where Can You Get Help?

You can contact the IRS through the instructions on the genuine notice or engage an authorized representative. Publication 1660 explains representation and possible Low Income Taxpayer Clinic help. Review authority, scope and costs before engaging assistance.

A free CuraDebt evaluation can help you review available tax-debt options. It is a separate step from contacting the IRS or submitting a hearing request, and does not extend a deadline or provide legal representation.

Frequently Asked Questions

Is CP90 A Balance Reminder Or A Hearing-Rights Notice?

CP90 informs you of an intended levy and Collection Due Process hearing rights. Read the specific action and hearing deadline on your letter rather than treat it as an ordinary balance reminder.

Does Calling The IRS Extend My CP90 Hearing Deadline?

No. A conversation with IRS Collection does not extend the period for a CDP hearing request. Track and follow the notice’s separate hearing-request instructions.

Which Form Does The IRS Identify For A Hearing Request?

The IRS identifies Form 12153 for a Collection Due Process or equivalent hearing request. Follow its current instructions and the submission route on the actual notice, and keep proof of what you submit.

Should I Use The Payment Address For My Hearing Request?

Do not assume so. Form 12153 directs you to the hearing-request address shown on the CDP notice. Review the letter’s current upload or mailing instructions.

Does CP90 Mean A Levy Has Already Happened?

The notice describes an intended levy. Check the letter, later correspondence and account records for any action already taken. Do not infer the account’s status from the notice number alone.

What If I Missed The CDP Request Deadline?

An equivalent hearing may remain available within its separate time limit. Its collection and court-review protections differ from a timely CDP hearing. Seek qualified help promptly about the actual notice.

Can I Request A Payment Plan If I Cannot Pay In Full?

A payment arrangement may be available when the IRS requirements are met. Confirm eligibility, approval and terms, and continue tracking any hearing-request deadline.

Does A CuraDebt Evaluation Replace The IRS Hearing Request?

No. The free, no-obligation evaluation helps you review available tax-debt options. It does not submit a hearing request, extend a deadline or provide legal representation.
