Georgia sets its garnishment rules in Title 18 of its code and applies the federal Consumer Credit Protection Act limit for ordinary consumer debts. The maximum per week is the smaller of 25% of your disposable earnings or the amount by which your weekly disposable earnings exceed 30 times the federal minimum wage, which is $217.50. A creditor must first win a judgment before it can garnish.
Higher Limits For Support, Taxes, And Student Loans
The 25% figure is for ordinary consumer debts. Child support can reach 50 to 60% of disposable earnings, the IRS uses its own exemption tables, and defaulted federal student loans can be garnished up to 15%. A creditor can never take more than the lower of the applicable state and federal limits.
